The Status of the 1940 Rebecca Film

As of now, Alfred Hitchcock’s Rebecca (1940) is NOT in the public domain. The film is still under copyright protection, meaning it cannot be freely distributed, remade, or used without permission.

The key reason? U.S. copyright law extends protection for films made after 1928, often lasting up to 95 years. Since Rebecca was released in 1940, it is currently under copyright and won’t enter the public domain in the United States until at least 2036—unless the copyright is extended again.

What About the Novel?

While the 1940 film remains under copyright, Daphne du Maurier’s original novel Rebecca (1938) is also NOT yet in the public domain in many countries, including the U.S. However, in countries where copyright lasts only 70 years after the author’s death, Rebecca entered the public domain on January 1, 2020 (Du Maurier passed away in 1989).

This means that outside the U.S., some publishers and creators may freely adapt the novel. It also led to Netflix’s 2020 remake of Rebecca, which was based on the book rather than the Hitchcock film.

Will Rebecca Ever Be Public Domain?
