What is the Public Domain?
The Public Domain is simply a domain arts and literature can fall into after a certain period. It means that when a work enters the public domain its ownership ceases to exist. The character, setting, plot and story all become void of copyright (within certain restrictions).
What constitutes Public Domain is individual to a country and its laws and regulations. Works are in the public domain if they are not covered by the intellectual property right known as copyright, or if the intellectual property rights to the works have expired Works automatically enter the public domain when their copyright has expired.
All works first published or released in the United States before January 1, 1929, have lost their copyright protection 95 years later, effective January 1, 2024. In the same manner, works published in 1929 will enter the public domain as of January 1, 2025, and this cycle will repeat until works published in 1977 enter the public domain on January 1, 2073. Works of corporate authorship will continue to adhere to the ninety-five-year term following the 2073 date. Under current copyright law, beginning in 2049, 1978 and beyond works by creators who died seven decades earlier will expire each year. For example, if a creator were to die in 2002, their works' copyright would last until the end of 2072 and enter the public domain on January 1, 2073. There you go thatâs the low down.
